F5 Radar — Terms of Service

These Terms govern your use of the F5 Radar mobile application on Android (package com.op27no2.f5radar) and on iPhone and iPad (App Store).

These Terms of Service (“Terms”) are a binding agreement between you and the developer of F5 Radar (“F5 Radar,” “we,” “us”). By downloading, accessing, or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

Important safety notice — please read. F5 Radar is provided for entertainment purposes only. It is not a safety tool, an alerting service, or an official source of weather information, and it must never be treated as one. The National Weather Service (NWS) and your local emergency-management authorities are the only official, authoritative sources for warnings and life-safety guidance. Data shown in the app — live or historical — may be delayed, incomplete, unavailable, or simply wrong, and the app may stop working at any time. Do not base any real-world decision on F5 Radar. Any decision affecting life, safety, health, evacuation, sheltering, travel, or property must be based solely on official NWS resources and the instructions of local authorities — never on this app. You assume all risk arising from your use of, or reliance on, the app. Always obtain and follow official NWS warnings and the instructions of local authorities during severe weather.

1. The service

F5 Radar displays weather-radar imagery, watches and warnings, historical storm information, and related features. Weather data is sourced from public U.S. government providers (e.g., NOAA / the National Weather Service) and third-party services, and is provided on an “as available” basis. The app — including its historical-event catalog, narratives, and educational content — is offered as an entertainment and educational experience, not as an official record, a forecasting service, or a substitute for official NWS products.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use F5 Radar. If you use the app on behalf of an organization, you represent that you are authorized to accept these Terms for it.

3. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use F5 Radar for your own non-commercial use on devices you own or control. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except where such restriction is prohibited by law.

4. Subscriptions and payments

F5 Radar offers optional auto-renewing subscriptions (Plus, Pro, and Ultra, each billed monthly or annually) that unlock additional features and content. Subscriptions are sold through the store you installed the app from: Google Play on Android, or the Apple App Store on iPhone and iPad.

Billing. Payment is charged to your Google Play account or your Apple Account at confirmation of purchase.
Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
Free trials / introductory offers. If an offer is provided, any unused portion of a free trial is forfeited when you purchase a subscription. Unless you cancel before the trial ends, it converts to a paid subscription.
Cancellation. You can manage or cancel your subscription at any time — on Android, in the Google Play Store under Payments & subscriptions; on iPhone or iPad, in Settings → your name → Subscriptions. Deleting the app does not cancel a subscription. Cancellation takes effect at the end of the current billing period; you retain access until then.
Refunds. Purchases are processed by Google Play or Apple and are subject to that store’s refund policies. We do not process payments and cannot issue refunds directly. App Store purchases can be refunded only by Apple (reportaproblem.apple.com).
Price and feature changes. We may change subscription prices or the features included in a tier. Price changes are handled according to the rules of the store you subscribed through, which may require your consent; changes do not apply retroactively to a period already paid for.

5. Acceptable use

You agree not to:

use the app for any unlawful purpose or in violation of these Terms;
interfere with, disrupt, overload, or attempt to gain unauthorized access to the app, our servers, or related systems;
scrape, harvest, or bulk-extract data or content from the app except as expressly permitted;
circumvent, disable, or defeat any access control, paywall, or security feature.

6. Intellectual property

The app, including its software, design, branding, and original content, is owned by us and protected by intellectual-property laws. Underlying weather data from U.S. government sources is generally in the public domain; our presentation, curation, and original written content are not. Third-party components (such as map data and SDKs) remain the property of their respective owners.

7. Third-party services

F5 Radar relies on third-party services, including Google (Play Billing, Firebase), Apple (App Store purchases, push notification delivery), and Mapbox. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services.

8. Entertainment use only; data accuracy; assumption of risk

F5 Radar is provided for entertainment purposes only. It is not a professional, emergency, forecasting, or life-safety service, and nothing in the app constitutes professional advice. Any real-world decision — including any decision affecting life, safety, health, evacuation, sheltering, travel, or property — must be based solely on official National Weather Service resources and the instructions of local authorities, never on this app.

You acknowledge that any data shown in the app, live or historical, may be delayed, incomplete, corrupted, mislabeled, or otherwise erroneous. Historical and editorial content in particular — archived radar, event summaries and narratives, statistics, damage and casualty figures, timelines, media, and other curated material — may contain errors, omissions, or inaccurate or false statements about historical events, and must not be treated as an authoritative or official record. For research, reporting, or any consequential purpose, consult primary sources (for example, NOAA/NWS archives and official storm surveys).

You acknowledge that weather is inherently dangerous and unpredictable, and that you use the app and rely on any data entirely at your own risk. You assume all risks arising from severe weather and from any action or inaction you take based on, or in reliance on, the app.

9. Disclaimer of warranties

THE APP AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT WEATHER DATA (LIVE OR HISTORICAL) WILL BE ACCURATE, COMPLETE, OR TIMELY, OR THAT DESCRIPTIONS, STATISTICS, OR OTHER CONTENT CONCERNING HISTORICAL EVENTS WILL BE ACCURATE, COMPLETE, OR FREE OF FALSE STATEMENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, RELIANCE ON ANY DATA IT PROVIDES, ANY WEATHER CONDITIONS, OR ANY DECISION MADE OR NOT MADE IN RELIANCE ON THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $25. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR THE EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the app or violation of these Terms.

12. Termination

We may suspend or terminate your access to the app at any time if you violate these Terms or for any lawful reason. You may stop using the app at any time. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Effective date” above and, where appropriate, through in-app notice. Your continued use of the app after changes take effect constitutes acceptance.

14. Governing law & venue

These Terms are governed by the laws of the State of Maryland, United States, and applicable U.S. federal law, without regard to conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the app will be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts, unless applicable law provides otherwise.

15. Additional terms for Apple devices

If you downloaded F5 Radar from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies, and the following terms apply in addition to the rest of these Terms:

Parties. These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content.
License. Your license to use the app is limited to use on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (Family Sharing may allow use by other accounts associated with the purchaser).
Maintenance and support. We are solely responsible for any maintenance and support of the app. Apple has no obligation to provide maintenance or support services for the app.
Warranty. To the extent any warranty applies despite Section 9, if the app fails to conform to it you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility, subject to these Terms.
Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
Intellectual property. If a third party claims that the app or your possession and use of it infringes that third party’s intellectual-property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim.
Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms. You must comply with applicable third-party terms (for example, your wireless data service agreement) when using the app.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
