F5 Radar — Terms of Service

These Terms govern your use of the F5 Radar mobile application (Android package com.op27no2.f5radar).

These Terms of Service (“Terms”) are a binding agreement between you and the developer of F5 Radar (“F5 Radar,” “we,” “us”). By downloading, accessing, or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

Important safety notice — please read. F5 Radar is an informational weather tool intended only as a secondary, supplemental source of weather information. The National Weather Service (NWS) and your local emergency-management authorities are the primary, official, and authoritative sources for warnings and life-safety guidance, and F5 Radar must at all times be treated as secondary to them. Radar, alerts, and other data may be delayed, incomplete, unavailable, or inaccurate, and the app may stop working at any time. Do not rely on F5 Radar — alone or as a primary source — for any decision affecting life, safety, health, evacuation, sheltering, travel, or property. You assume all risk arising from your use of, or reliance on, the app. Always obtain and follow official NWS warnings and the instructions of local authorities during severe weather.

1. The service

F5 Radar displays weather-radar imagery, watches and warnings, historical storm information, and related features. Weather data is sourced from public U.S. government providers (e.g., NOAA / the National Weather Service) and third-party services, and is provided on an “as available” basis.

2. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use F5 Radar. If you use the app on behalf of an organization, you represent that you are authorized to accept these Terms for it.

3. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use F5 Radar for your own non-commercial use on devices you own or control. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except where such restriction is prohibited by law.

F5 Radar offers optional auto-renewing subscriptions (“Pro”) that unlock additional features and content.

6. Intellectual property

The app, including its software, design, branding, and original content, is owned by us and protected by intellectual-property laws. Underlying weather data from U.S. government sources is generally in the public domain; our presentation, curation, and original written content are not. Third-party components (such as map data and SDKs) remain the property of their respective owners.

7. Third-party services

F5 Radar relies on third-party services, including Google (Play Billing, Firebase) and Mapbox. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services.

8. Informational use & assumption of risk

F5 Radar is provided for general informational purposes only and as a secondary, supplemental source of weather information. It is not a professional, emergency, forecasting, or life-safety service, and nothing in the app constitutes professional advice. The National Weather Service and your local authorities remain the primary, authoritative sources at all times. You acknowledge that weather is inherently dangerous and unpredictable, that data may be delayed, wrong, or unavailable, and that you use the app and rely on any data entirely at your own risk. You assume all risks arising from severe weather and from any action or inaction you take based on, or in reliance on, the app.

9. Disclaimer of warranties

THE APP AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT WEATHER DATA WILL BE ACCURATE, COMPLETE, OR TIMELY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, RELIANCE ON ANY DATA IT PROVIDES, ANY WEATHER CONDITIONS, OR ANY DECISION MADE OR NOT MADE IN RELIANCE ON THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $25. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR THE EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the app or violation of these Terms.

12. Termination

We may suspend or terminate your access to the app at any time if you violate these Terms or for any lawful reason. You may stop using the app at any time. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Effective date” above and, where appropriate, through in-app notice. Your continued use of the app after changes take effect constitutes acceptance.

14. Governing law & venue

These Terms are governed by the laws of the State of Maryland, United States, and applicable U.S. federal law, without regard to conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the app will be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts, unless applicable law provides otherwise.
